High Court & Magistrate Court Litigation

Litigation in the High court can be either summons or motion proceedings.

Motion proceedings are based on a dispute which is argued on “paper” consisting of affidavits and interpretation of laws. It is a shorter process. 

Summons must be issued when there is a factual dispute and verbal evidence will have to be led. It is a longer process, and the matter will proceed in court once a trial date has been allocated. The Attorney, after consultation with the client, will advise which option is the best. 

We also attend to matters in both the Magistrate and Regional Court. These courts have jurisdiction in matters where the claim amount is less than R400 000. Cases in the Magistrates’ Courts are often finalised much quicker than those in the High Courts.
